The Supreme Court in Ibiza has rejected a modification to San Antonio's Land Use Plan which affected the Calo des Moro area, and in particular five hotels, including the Sol Bahia apartments. 
 

The events go back to 1986 when the Town Hall of San Antonio, Ibiza issued a license to build a block of apartments on a piece of land which should only have been used for a family house.

Three years later, after complaints from neighbours, the Court cancelled the permit, whilst ordering the building (Sol Bahia) to be demolished. However, the Town Hall persisted in trying to modify its Land Use Plan to make the building legal, as well as four other hotels in the area.

In 1997 the Island Council agreed a modification to the Plan. However, this has now been rejected by the Supreme Court, with the sentence claiming the sole purpose of changing the classification of the land was simply to legalise buildings which had been built without the appropriate permission, describing the explanations given by the Town Hall in Ibiza for changing the classification of the land as "feeble".

A spokesman for the Town Hall claimed the future of the five buildings was still unclear, claiming the administration's lawyers would study the case and take the most appropriate action.
